Of course she can't walk all over you and tell you not to talk to him, because she doesn't own you and she doesn't own him. You should just let her know how you feel about him and tell her that he makes you happy because, being human, she may get jealous or upset, so we want to prevent that.

You should definitely wait until you feel comfortable talking to her about it, but you should probably go to her about it before she comes to you about it because that might not end well.

Well, first of all, she broke up with him a long time ago and already has someone else, so he doesn't belong to her and both you and him have every right to talk to each other.
If she's not comfortable with you talking to him though, then you should probably talk to her about it and tell her how you feel. If she's really your best friend, then she won't hold you back.
